Terms of Service

These Terms of Service ("Terms") are entered into between ARFIKEDA ("ARFIKEDA", "Platform", "we"), operating the website at arfikeda.com and related services, and the natural or legal person using the services ("User", "you"). These Terms govern the User's access to and use of the services provided through the ARFIKEDA platform, together with the mutual rights and obligations of the parties. By registering or using the services, the User declares that they have read, understood and accepted these Terms in full. If you do not accept these Terms, you must not use the services.

You may need to create an account to use the full range of services. You warrant that the information provided during registration is accurate, current and complete. You are solely responsible for the security of your account and the confidentiality of your password. You are responsible for all activity carried out through your account. If you detect any unauthorized access, you must notify us immediately at contact@arfikeda.com. Persons under the age of 18 may not use the services. Persons acting on behalf of a legal entity confirm that they are authorized to represent that entity.

ARFIKEDA provides AI-powered automation products, chatbot solutions, review management and similar digital services on a subscription model. Each product is independent and has its own technical requirements, configuration and service scope. Features stated on product pages are binding; however, ARFIKEDA continuously develops its services and may improve features. Some services rely on third-party providers (e.g. language models, payment infrastructure, cloud services) and may be affected by the availability of those providers.

The User agrees to use the services in accordance with applicable law, good morals and these Terms. The following are prohibited: • Using the services for unlawful, harmful purposes or to infringe the rights of others • Threatening the security of the Platform, reverse engineering or attempting unauthorized access • Sending automated requests that overload the systems or otherwise abusing the service • Producing or distributing spam, malware or misleading content • Sharing account credentials with third parties without authorization The User is responsible for the lawfulness of the data they process through the service and for obtaining any necessary consents.

Services are offered in return for the subscription fees stated on the product page. Payments are collected through Stripe, our secure payment infrastructure provider. Unless otherwise stated, subscriptions automatically renew at the end of the selected period (monthly/annual). You may cancel your subscription at any time before renewal. Certain products may include a free trial period and/or a deferred setup fee. These conditions are explained on the relevant product page and on the Distance Sales Agreement and Cancellation & Refund pages. Taxes and statutory obligations apply in accordance with applicable law.

The intellectual property rights in the Platform's software, design, trademarks, logos, text, visuals and all other content belong to ARFIKEDA or the respective rights holders. The User is granted only a limited, non-exclusive, non-transferable right to use the services for their intended purpose. This does not grant any right to copy, reproduce, distribute or create derivative works. Content that the User uploads to or generates through the service remains the property of the User; ARFIKEDA processes such content solely to provide the service.

ARFIKEDA uses reasonable efforts to provide the services without interruption or error; however, temporary interruptions may occur due to maintenance, updates, technical failures or third-party causes. ARFIKEDA reserves the right to change the scope and features of the services and the terms of these Terms upon prior notice. Material changes will be communicated to the User by email or through the platform. Continuing to use the service after changes take effect means you accept the updated terms.

The services are provided "as is". To the maximum extent permitted by applicable law, ARFIKEDA makes no implied warranty of fitness for a particular purpose. ARFIKEDA shall not be liable for indirect, incidental, special or consequential damages, loss of data or loss of profit. ARFIKEDA's total liability shall in any event be limited to the subscription fees paid by the relevant User in the preceding 12 months. AI outputs are probabilistic and may contain errors; the User is responsible for verifying outputs in critical decisions. This clause does not limit mandatory consumer rights.

The User may terminate the Agreement at any time by cancelling their subscription and requesting closure of their account. ARFIKEDA may suspend the account or terminate the Agreement if the User breaches these Terms, abuses the services or engages in unlawful activity. Upon termination, access continues until the end of the paid period; refund conditions are set out on the Cancellation & Refund page. Termination does not extinguish accrued payment obligations.

These Terms are governed by the laws of the Republic of Türkiye. The parties shall primarily seek to resolve disputes through good-faith communication. For unresolved disputes, the courts and enforcement offices of the Republic of Türkiye have jurisdiction. For Users who qualify as consumers, the Consumer Arbitration Committees and Consumer Courts have jurisdiction within the applicable monetary limits.
