BUYER:
The User who purchases the service and whose details are entered into the platform during the order/registration ("Buyer").
This agreement is drawn up pursuant to Turkish Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts.
The subject of this Distance Sales Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the digital subscription service ordered electronically by the Buyer through the ARFIKEDA website (arfikeda.com), the characteristics and price of which are stated below.
The Buyer acknowledges that they have read and are aware of all preliminary information regarding the essential characteristics of the service, the sale price, the payment method and performance, and have provided the necessary confirmation electronically.
3
Product/Service Details and Price
The type, scope, subscription period (monthly/annual) and the sale price (including VAT) of the service are clearly shown at the time of order on the relevant product page and the payment screen.
Listed prices are valid until updated. Promotional and discounted prices are valid for the announced period and revert to the standard tariff at the end of that period.
In addition to the subscription fee, certain products may include a one-time setup fee, which is stated separately on the product page.
Payments are collected by credit/debit card through Stripe, a PCI-DSS compliant secure payment infrastructure provider. ARFIKEDA does not store your card details; this information is processed directly by the payment provider.
The subscription fee is collected in advance for the selected period and renews automatically at the end of the period. For products offering a free trial, no fee is charged during the trial; the subscription may automatically convert to a paid period at the end of the trial.
5
Performance and Delivery
The service is digital and is made available through the Buyer's account following payment confirmation. For some products (e.g. services requiring configuration or approval), access is provided once the setup and approval processes are completed.
As there is no physical delivery, there are no shipping or delivery charges. Access to the service requires an internet connection and a suitable device.
As a rule, the Buyer has the right to withdraw within 14 (fourteen) days from the date the contract is concluded, without giving any reason and without paying any penalty.
To exercise the right of withdrawal, it is sufficient to send a clear notice to contact@arfikeda.com within this period. The relevant amount will be refunded using the payment method you used within 14 days of our receipt of the withdrawal notice.
Details of cancellation and refund processes are set out on the Cancellation & Refund page.
7
Exceptions to the Right of Withdrawal
Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for contracts for intangible digital content/services performed instantly in electronic form, where performance has begun with the Buyer's express consent and the Buyer has accepted that they will lose the right of withdrawal.
Therefore, the right of withdrawal may be limited for periods started after the free trial or after actual access to the service has been provided. To offset this limitation, ARFIKEDA offers a free trial and easy end-of-period cancellation.
8
Subscription Renewal and Cancellation
Subscriptions renew automatically at the end of the selected period. The Buyer may cancel the subscription at any time through the subscription management screen or customer portal.
The cancellation takes effect at the end of the current paid period; access to the service continues until that period ends. No refund is made for partially used periods, save for mandatory legal cases.
By confirming the preliminary information and service conditions electronically, the Buyer acknowledges that they have obtained the information that must be provided by the seller prior to the conclusion of distance contracts.
In cases of force majeure (natural disaster, infrastructure outage, third-party service failure, etc.), the obligations of the parties are suspended for the duration of the force majeure.
10
Competent Court and Complaints
In disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence have jurisdiction within the monetary limits announced by the Ministry of Trade.
For complaints and requests: contact@arfikeda.com — +90 544 419 55 57
The Buyer acknowledges that they have read and accepted all the terms of this agreement and concluded it electronically by confirming the order, which entails a payment obligation. The agreement takes effect on the date the order is confirmed.
